Terms and Conditions
For the purpose of these conditions, the term HIRER shall mean an individual Hirer or, where the Hirer is an organisation, the authorised representative.
1. Who can hire the MUGA and for what use?
1.1 The MUGA can be hired by anyone who is aged 18 or over at the time of booking, for
approved activities*. The person signing the booking form online is deemed to be the ‘person in charge’. If the person signing the booking form is not going to be present during the hire period, they must name a responsible person who will be. The Hirer, or responsible person, will remain, and be responsible for, the supervision and care of the facilities hired, their fabric and contents, during the period of hiring.
1.2 The Hirer shall not use the MUGA facilities for any purpose other than that described in
the hiring agreement and shall not sub-let the facility. They shall not do, or bring onto the facility, anything which may endanger the premises, other people, or render invalid any insurance policies relating to the facility. Morwenstow Parish Council (MPC) insurance does not cover activities carried out by MUGA hirers. If you are an official group - you will need your own insurance for your activities. General hirers using the facility do so at their own risk.
1.3 The MUGA is open access and available for all to use between the hours 8am - 9pm Monday to Friday. Saturdays are 8am - 7pm and Sundays/Bank Holidays are 10am - 6pm throughout the year but can be booked for dedicated sessions. The last booking ends at 9pm. Shorter winter days will reduce availability, as there is no lighting.
2. Booking
2.1 All applications for booking of the MUGA must be made via the website. The minimum hire period is 90 minutes.
2.2 Arrangements for a regular ‘contract’ booking may be made. The Hirer will be required to complete a booking form and to sign to accept these Conditions of Hire.
2.3 ‘One-off’ bookings may be made on the website. The Hirer shall be required to complete and sign a booking form to accept these Conditions of Hire.
2.4 All Hirers will be required to give notice by email to cancel their booking. If the booking
has been made for Saturday or Sunday the cancellation notice will be required by 2pm on the Friday. We will endeavour to move any bookings that can not be completed due to adverse weather conditions.
2.5 Morwenstow Parish Council reserves the right to refuse a booking without notice.
2.6 For regular ‘contract’ bookings, Morwenstow Parish Council may cancel the hire
agreement at any time either before or during the term of the agreement upon giving 7 days’ notice in writing to the Hirer. Your fee will be refunded.
2.7 For ‘one-off’ bookings, Morwenstow Parish Council may cancel the booking at any time without notice. Your fee will be refunded.
3. Hirer’s responsibilities and inconvenience to neighbours
3.1 The Hirer will be responsible for the supervision and care of all users of the MUGA area during the period of hire. The Hirer will be responsible for supervising the behaviour of all persons using the premises, whatever their capacity.
3.2 Any equipment hired must be returned as per instructions given at the time of hiring.
3.3 Please respect our neighbours. Hirers using the MUGA are requested to ensure that
noise levels and inconvenience to our neighbours and other users is kept to a minimum.
4. General conditions
4.1 The Hirer/responsible person shall ensure that clean, soft soled footwear is worn by
those using the MUGA. The wearing of boots with studs, spikes or blades is strictly prohibited.
4.2 The Hirer/responsible person shall ensure that no animals are brought onto the MUGA,
except for registered assistance animals.
4.3 No drinks, other than water, are allowed on the MUGA. Alcohol, smoking/vaping,
chewing gum and food are strictly forbidden.
4.4 In the event of the MUGA or any part thereof being rendered unfit for the use for which it has been hired, Morwenstow Parish Council shall not be liable to the Hirer for any resulting loss or damage.
4.5 At the end of the hiring period, the Hirer/responsible person shall be responsible for
leaving the premises in a clean and tidy condition.
4.6 All Hirers must ensure that they vacate the MUGA at the end of their hire period to allow other hirers to access the facility at their allotted time slot.
The booking of the MUGA by the Hirer indicates acceptance of all the above conditions of hire.
These conditions may not be varied in any way, except with the prior approval of Morwenstow Parish Council.
Any breach of these conditions will result in refusal to permit the Hirer to make any future
bookings for the use of the MUGA.
Morwenstow Parish Council reserves the right to make alterations to any of the Conditions of Hire from time to time and at its own discretion.
* Approved activities refers to any sporting activity for which the MUGA was designed.
